Kanibal Media Ltd. (Hereinafter: "Kanibal") makes a concerted effort to respect user privacy in the Software it manages and operates (Hereinafter: "The Software"). The terms of these privacy policies listed below constitute an integral part of the terms of use of the Software. All definitions and terms in these privacy policies will be as defined in the terms Of use unless otherwise required by the context.
Listed below are explanations on the manner and policies that Kanibal adopts regarding information submitted to it by users in the Software or that it complied during its use.
In order to use the Software and some of the services made available in the Software, registration may require. As part of the registration, you may be required to provide personal information such as your name, address, telephone number and contact information for you or your email address or method of payment to purchase content, your ID number and the ID number of your device. The mandatory fields that must be completed for registration will be explicitly marked. Since Kanibal will only request the information necessary for the service to which you registered, in some services, you may be asked to add and provide additional information that is required by the nature of the service. Failure to provide the information in the mandatory fields will prevent you from registering for services that require registration.
As an integral part of the registration process for the Software, and as a prerequisite for completing the registration process, Kanibal will be entitled to verify your identity based on the information you provided. The data you will provide during registration to the Software services will be stored in the Kanibal database. You have no legal obligation to provide the Information we request but failure to provide it might prevent all or some of our services from being provided to you.
During use of the Software, information about your habits, contents and services you gained may be accumulated, as well as about information or advertisements you read in the Software, Log data (includes your Internet Protocol address, browser type and settings, the date and time of your request, and how you interact with our Services), the pages you viewed, the features you use, the actions you take, the offers and services that interested you, the device, operating system and browser you use, device identifiers, methods of payments you used, location of the computer used to access the Software, any data that you provide in the Input to our Services ("Content"), including your prompts and other content you upload, including by communicating with us, such as files, images, and audio, depending on the features you use, etc. Kanibal is entitled to save the information in its database (including in the databases of its subsidiaries or related companies) as well as data submitted during the registration to the various services in the Software strictly in compliance with this privacy policy or in accordance with the law – inter alia, for the purpose of purchasing content and services in the Software, to update regarding sales and/or services; to adapt ads displayed to you during your visit to the Software in your areas of interest; to contact you if necessary or to analyze and provide statistical information to third parties, including advertisers; to ensure normal operation and development of the Software, to improve and enhance the service provided; and for any other purpose listed in this privacy policy or in the terms of use of any of the relevant services in the Software.
At the same time, Kanibal will not provide your personal information to any third parties (with the exception of subsidiaries and related companies; or companies that provide it services of inspection, analyze and personalization of information – and provided that such companies will undertake to avoid making any other use of the above information or passing it any other party), if said information personally identifies you unless:
At the time you purchase services from Kanibal's commercial partners or from its service providers, or in joint activities with Kanibal and a third party that are displayed in the Software. In these cases, these partners or service providers will receive the information they need to complete the purchase, to manage the relevant content activity and to maintain contact with you.
You granted explicit consent and/or request.
Whenever Kanibal believes that delivery of said information is necessary to prevent serious harm to your body or property or the body or property of a third party.
If you violate the terms of use in the Software or if you, through the Software or via the Software, carry out transactions that are construed as violations of the law, or attempt to carry out said actions in these cases.
If Kanibal receives a judicial order instructing it to provide your information or information about you to a third party.
In the case of any dispute, argument, claim, demand or legal proceeding, if any, between you and Kanibal.
If Kanibal organizes activities in the Software in another corporate frame and if it merges with another entity – it will be entitled to transfer to the new corporation a copy of the information it has on you in the Software or any other statistical information in its possession, pursuant to this corporation adopting the provisions of this privacy policy.
You hereby declare and undertake that all of the information that you provide and/or update in the Software is true and accurate and that you have registered and/or provided the information in your name and for yourself only and not under the name and/or for any third parties, with the exception of when you explicitly authorized this to be done, in the terms of use, including privacy policies and/or designated terms of use.
Users under 18 must have permission from their parent or guardian to use our Services.
As for users under 13, our Services are not directed to, or intended for, children under 13. Therefore, we do not knowingly collect personal data from children under 13. If you have reason to believe that a child under 13 has provided us personal data through the Services, please email us at igentityai@gmail.com. We will investigate any notification and, if required and appropriate, delete the personal data from our systems.
Kanibal desires to occasionally send you (by E-mail , text messages, notifications through the app etc.), advertisements, information regarding its services as well as marketing and promotional information - whether information it publishes itself or received by it from other advertisers. These advertisements will be delivered to an email address and/or to the device from which you are running the Software, according to the user's information exists on the device. Running the Software means that you agree to receive such information. However, you can ask to refrain from receiving such promotional information at any time to, either through the Software or by sending an email to: igentityai@gmail.com
The Software may use Cookies and/or other Data Files for its current and regular operations, including in order collecting statistical data on use of the Software, to verify information, to adapt the Software to your personal preferences and for information security purposes. Cookies and Data Files are text files created by the Software in accordance with a command from the Kanibal computers and sent to your Viewing Device. Some of the Cookies and/or Data Files will expire once the Software closes and others will remain in the permanent memory of your viewing device. The Cookies and Data Files contain an array of information such as Content you viewed, length of time you remained in the Software, the number of views of Content information, information that you requested to view when entering the Software, etc. They are also used to eliminate the need to enter your information each time you visit areas in the Software that require registration. The information in the Cookies and Data Files is encrypted. Kanibal adopts maximum precautionary measures to ensure that only Kanibal computers can read and understand the information stored in them. If Cookies or Data Files are sent to you by advertisers in the Software, the storage and processing of such Cookies and Data Files will be subject to the privacy policies of such advertisers and not to the privacy policies of Kanibal.
The more you use the same Subscription via several different viewing devices, the Cookies and the Data Files may be sent to all devices used, and said information will be stored for each viewing device in the Subscription.
You can delete the Cookies and Data Files at any given moment. You can do this by entering the Main Menu in your device, and selecting "My account", "Viewing Settings", and "History settings". It is recommended that you do this only if you are convinced that you do not want the Software to be adapted to your preferences. Since Cookies occasionally spare you from the need to enter usernames and passwords, do not delete them unless you are confident that you have first recorded in a safe location all of the information you need to use in the Software.
Some of the services in the Software are managed by Kanibal's commercial partners. These services are submitted through the computers of said partners and not through Kanibal computers. During your use of these services, you may be asked to provide Personal Information and/or other Information may be collected about you. Use of this information is subject to the privacy policies of the managers of these services and not to Kanibal's privacy policies and Kanibal has no liability for such use by third party service providers. It is therefore recommended that you review their privacy policy documents.
The ads appearing in the Software come from the computers of the advertising entities. In order to manage the ads, these companies impose Cookies, Data Files, web beacons or other files with unique identification properties that are embedded into the web pages and that help compile information on software viewing and use. The compiled information does not identify you but only asks to adapt the ads that are displayed to you to areas that interest you. The use that these companies make of Cookies, Data Files, web beacons and files is subject to their private policies and not the policies of Kanibal. If you want to review the privacy policies of the companies that advertise in the Software, which we advise you to do, you can do so on their websites.
Kanibal (and/or its agents) may compile and analyze information on the volume of use of the Software, the frequency of use, user access sources, volume and nature of Content viewed, etc. In order to compile the user information, Kanibal uses various technologies that help it monitor the actions in the Software. For example, reviews the popularity of various Content and services in the Software. The compiled information is statistical in nature, does not personally identify you and is designated strictly for analysis, research and control purposes.
Kanibal implements in the Software information security systems and procedures that seek to reduce the risks of unauthorized entry into Kanibal computers, but do not completely eliminate such risk. Kanibal does not undertake that the services in the Software are completely immune to unauthorized access to the information stored in its computers.
Credit card information submitted through the Software is secured with secure socket layer encryption technology, and neither Kanibal (nor its collection agents, if any) save the customer's credit information once the charge has been transferred to the credit card company.
We also request that our third-party service providers (including our collection agents) use commercially reasonable security measures to protect your Personal and other Information from unauthorized access or use. We are constantly working to improve our security measures to keep up with technological developments and keep your Personal Information secure against unauthorized access and illegal or accidental destruction.
However, you acknowledge that no data transmission is guaranteed as 100% secure, and Kanibal does not guarantee that the Software or the services in the Software will be error free or completely immune to unauthorized access. Therefore, you should take special care in deciding what information you provide to the Services. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third-party websites.
In accordance with the Israeli Privacy Protection Law 5751-1981, every individual is entitled to review on his own, or via a proxy who has his written authorization or a legal guardian, his personal information that is stored in a database. Anyone who reviewed information and found it to be incorrect, incomplete, ineligible or outdated is entitled to contact the database owner and request that the information be amended or deleted. If the database owner refuses to comply with this request, he must notify the applicant in the manner set forth in the statute. Should the database owner refuse to allow a review and issues notice of refusal to amend or delete the information, the party requesting the information will be entitled to file a motion with the magistrate court in the manner prescribed in the statute.
In addition, if the information in the Kanibal database is used to personally contact you, based on your affiliation with a population group, that was established in accordance with one or more characteristics of people whose names are included in the database ("Contact with commercial proposal"), you are entitled in accordance with the Israeli Privacy Protection Law 5751-1981 to issue written demand that the information pertaining to you be deleted from the database. Kanibal will, in this case, delete this information it requires to contact you with commercial proposals. As previously mentioned, the information Kanibal requires to manage its business, including documentation of commercial and other activity that was carried out in the Software, will continue to be saved in Kanibal in accordance with the law, but will no longer be used to contact you. If within 30 days, you do not receive confirmation that the information that Kanibal was asked to delete was actually deleted in accordance with this article, you will be entitled to submit a motion with court in the manner prescribed in the statute that by virtue of the law, Kanibal will be instructed to comply with said instruction.
Kanibal is entitled to change, from time to time, the provisions in this Privacy Policy. Notice of any material changes are made to this policy, to the provisions that pertain to the use of personal information that you provided will be published on the Software.
